Tesla takes on car dealers in a fight to the death

Tesla Motors, the California-based electric-car start-up, is anything but an epitome of American-style free-market entrepreneurship.

Its Model S performed and sold better than many critics, this one included, expected. Ditto for its stock price, which is more than $240 per share, though the companys market capitalization of nearly $29 billion half that of Ford strikes many critics, this one included, as unsustainable.

But Teslas success would have been impossible without a big assist from government: a $465 million, low-interest Energy Department loan (since repaid); substantial tax credits for purchasers; tens of millions of dollars worth of air-pollution credits awarded by California regulators to Tesla and sold to competitors who, under state law, had to buy them.

The (dubious) policy rationale is that a shift to electric cars would lower carbon emissions significantly and that the way to achieve such a shift is by subsidizing the manufacture and sale of a luxury vehicle that only the 1 percent can afford.

In one important respect, however, Tesla stands on the side of the free-market angels: The companys business plan calls for selling vehicles directly to consumers, rather than through auto dealers a major challenge to the dealers costly, outmoded monopoly on new-car sales in the United States.

State laws generally prohibit anyone but a licensed franchisee from selling new cars. A 2000 report by a Goldman Sachs analyst estimated that direct sales would save consumers $2,225 per new car, assuming an average vehicle price of $26,000.

So far, Teslas effort has met with mixed success. It has opened stores in Minnesota, Massachusetts and Washington but struck out in Texas and Arizona. Virginia rebuffed Teslas plan for an outlet in Tysons Corner last year. Tesla sued but withdrew the lawsuit in return for a chance to apply for a dealership license.

The companys most recent defeat came Tuesday, when the New Jersey Motor Vehicle Commission adopted a rule that would effectively force Tesla to close two stores in the Garden State. A Tesla spokesman called it an affront to the very concept of a free market, which is hypocritical coming from a government-backed firm but absolutely true.

The dealer-based distributional system divides the United States into sales territories, each one allocated to a dealer, on the theory that a protected market compensates for the risk of investing in a brick-and-mortar building and holding a large inventory of cars.

Long ago, this business model might have made sense, but today technology takes much of the risk out of inventory management and enables consumers to understand their choices without help from a commissioned salesman. In fact, the Consumer Federation of America reported in 2013 that [m]isrepresentation in advertising or sales of new and used cars, lemons, faulty repairs, leasing and towing disputes was the top source of consumer complaints to state officials, as it had been in previous years.

The dealer-based system was obsolescent even before the Internet, which is why Detroit automakers tried to streamline it decades ago, only to be thwarted when dealers turned to state legislatures for protection.

As Web-based retail sales of other products began to take off in 1999, a General Motors executive said publicly that 80 percent of new-car sales could be factory-direct orders made online by 2003. He forgot about the dealer lobby, which mobilized to win state bans on Internet sales by anyone except an existing licensed dealer.

The laws purpose, and effect, is to head off innovation. Of course, changes might make the car-buying experience more pleasant and less expensive for consumers but cut dealers profits or put them out of business altogether. This is why dealers see Tesla as a mortal threat and are fighting it accordingly.

Meanwhile, even more radical alternatives to conventional dealerships are in the works. Many were on display at the just-completed three-day Hackomotive conference in Santa Monica, Calif., sponsored by the automotive Web site Edmunds.com.

According to the New York Times, one new system, Carvoyant, provides a secure means of test-driving new cars without a salesperson thus refuting a frequently made argument for the necessity of dealerships.

The stage is set for protracted political and regulatory warfare between car dealers and disruptive market entrants. Given the dealers proven clout, it would be unwise to bet heavily against them.

Still, Tesla chief executive Elon Musk may be that rare individual who can afford to fight the dealers and cant afford to lose. Im no fan of his electric-car dreams or the government subsidies that have enabled them. But in this battle, Im rooting for him.

When I read the directions to put the seeds in the dirt, I was disbelieving. Here is very near the same number of seeds as here is dirt. Fun to grow. First, you put it in a dark place to bud. Later, place it in the sun. Water it often. The grass does grow quite promptly. My partner ongoing pointing out to me how fast and how tall the grass grew on our ridge. It did as it was advertised; in below a week I had a nice modest container full of grass. Two of my cats loved it, the third was not attracted, but that is habitual for her. The only protest I have is that the container is too set alight. When one of the cats would try to chew off a stem, the container would lift off the ground, making it actually hard for them to break the stem off. I ended up having to hold it for them, which earnings I can't just place it out for them to bite to eat as they delight.A note for kitten owners: My 5 month old kitten had trouble intake this, I think his teeth aren't spaced quite aptly yet to be able chew the stems off. I ended up tearing modest pieces off and popping them in his backtalk, which he was perfectly ok with, the lazy bugger. DMX will fight George Zimmerman in boxing match, promoter says

PHILADELPHIA Damon Feldman has made a name for himself over the years promoting many celebrity boxing matches, from Danny Bonaduce to Jose Canseco to Dustin Diamond. His newest fight is likely to be his most explosive yet.

Feldman says hes chosen rap star DMX, whose real name is Earl Simmons to fight George Zimmerman, the man known for the fatal shooting of Trayvon Martin, reports CBS Philadelphia. Simmons is 43 years old, and Zimmerman is 30 years old.

Ive gotten over 15,000 emails, I had to end [the submissions to fight Zimmerman] there, Feldman told a Philadelphia radio show. Very angry, I had everything from celebrities to [rapper] The Game I got into it with him on TMZ the other day. Floyd Mayweather Sr. is the referee with this, were very excited.

World leaders mourn Sharon's death

President Obama expressed sorrow Saturday about the death of Israeli Prime Minister Ariel Sharon, joining other United States and world leaders in commenting on the life and passing of Sharon.

On behalf of the American people, Michelle and I send our deepest condolences to the family of former Israeli Prime Minister Ariel Sharon and to the people of Israel on the loss of a leader who dedicated his life to the State of Israel, the president said. We reaffirm our unshakable commitment to Israel's security and our appreciation for the enduring friendship between our two countries and our two peoples.

The former prime minister and general was at the height of his power when he suffered a stroke in 2006 and fell into an irreversible coma. He died Saturday at 85.

Sharon was "a brave soldier and a daring leader who loved his nation and his nation loved him," said President of the State of Israel Shimon Peres, a longtime friend and rival. "He was one of Israel's great protectors and most important architects, who knew no fear and certainly never feared vision."

Sharon died at Tel Hashomer hospital just outside Tel Aviv, where his family had gathered at his bedside over the past several days as his vital organs reportedly deteriorated.

Ariel Sharon's journey was Israels journey, Secretary of State John Kerry said. The dream of Israel was the cause of his life, and he risked it all to live that dream. During his years in politics, it is no secret that there were times the United States had differences with him. But whether you agreed or disagreed with his positions you admired the man who was determined to ensure the security and survival of the Jewish State.

Sharon, an iconic figure who fought in three wars before entering politics, was elected prime minister in 2001. He suffered a stroke in January 2006, at the height of his political power, and remained comatose since then.

However, in 2011 his son Gilad told the New York Times his father could move his fingers when he asked him to, adding, "I am sure he hears me."

In the months leading up to his stroke, longtime hardliner Sharon had shocked his political base by expelling Jewish settlers from 21 Gaza settlements and from four on the West Bank

He also resigned as head of the Likud party and formed a new centrist party called Kadima ("Forward").

Sharon's longtime rival and current prime minister, Netanyahu, was elected his replacement as head of Likud.

"Laura and I join our friends in Israel and around the world in mourning the loss, said former President George W. Bush, commenting for himself and his wife. He was a warrior for the ages and a partner in seeking security for the Holy Land and a better, peaceful Middle East.

However, Sharon was loathed by many Palestinians as a bitter enemy who did his utmost to sabotage their independence hopes -- by leading military offensives against them in Lebanon, the West Bank and Gaza and a settlement drive on the lands they want for a state.

Word of the former Israeli prime minister's death, elicited muted expressions of satisfaction. Some said they regret he wasn't held accountable for his actions during his lifetime.

"He wanted to erase the Palestinian people from the map," said Tawfik Tirawi, who served as Palestinian intelligence chief when Sharon was prime minister a decade ago. "He wanted to kill us, but at the end of the day, Sharon is dead and the Palestinian people are alive."

In the Gaza Strip, Khalil al-Haya, a leader in the Islamic militant group Hamas, said Sharon caused suffering to generations of Palestinians.

"After eight years, he is going in the same direction as other tyrants and criminals whose hands were covered with Palestinian blood," he said.

Sharon suffered a mild stroke in December 2005. A little more than two weeks later he suffered a massive intra cerebral hemorrhage from which he never recovered.

Sharon's deputy, Ehud Olmert, was elected prime minister two months later.

Sharon was born February 26, 1928 in the then British Mandate of Palestine to a family of Lithuanian Jews. By the age of 10 he had entered the Zionist youth movement Hassadeh and later the Haganah, the military precursor to the Israel Defense Forces.

His military career flourished as he became a commander in the Israeli army, celebrated as a military strategist.

He was an instrumental figure in the 1956 Suez War, the Six Day War of 1967, the Yom Kippur War of 1973 and as Minister of Defense directed the 1982 Lebanon War.

Sharon joined the Likud party after retiring from the military, serving in a number of ministerial posts and then as party leader in 2000 before becoming prime minister from 2001-2006.

Widowed twice, he is survived by his sons Gilad and Omri.
